Welcome to HiLo, where gamers connect, share, and celebrate their favorite moments. This Terms of Service Agreement (“Agreement”) governs your use of HiLo (“Service,” “Platform,” “We,” “Us,” or “Our”). By using HiLo, you agree to these Terms of Service, our Privacy Policy, and any additional terms or guidelines we provide.

1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 13 years old and agree to be legally bound by this Agreement. If you do not agree to these Terms, you must discontinue using HiLo.

2. Changes to Terms
We reserve the right to update or modify these Terms at any time, with or without notice. We will make reasonable efforts to inform you of significant changes, but it’s your responsibility to periodically review these Terms. Your continued use of the Service signifies your acceptance of any changes.

3. Account Registration and Responsibilities
To access certain features of HiLo, you must create an account. You agree to:

  • Keep your login credentials confidential.

  • Be responsible for all activity that occurs under your account, whether authorized or not.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in activities that could harm HiLo or its users.

  • Engage in any activity that is abusive, harassing, defamatory, or discriminatory.

  • Post content that is misleading, pornographic, or otherwise objectionable.

HiLo may remove or restrict access to content that violates these guidelines, and users who breach these rules may be banned from the platform.

5. Content Ownership and Licensing
You retain ownership of the content you post on HiLo (“User Content”). By posting, you grant HiLo a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, reproduce, modify, create derivative works, distribute, and display your User Content in connection with operating the Service.

You represent and warrant that you have the rights to grant this license and that your content does not infringe any third-party rights.

6. Platform Rules and Enforcement
We want HiLo to be a fun and engaging space. To ensure this, we reserve the right to enforce our guidelines through warnings, suspensions, or permanent bans. We also have the right to remove any content that:

  • Violates these Terms.

  • Could harm our community or is otherwise deemed inappropriate.

7. Termination and Account Deletion
You may terminate your account at any time. Upon termination, your rights to use the Service will immediately cease. HiLo may also terminate or suspend your account without notice if you violate these Terms or engage in conduct harmful to the community. Even after termination, the provisions related to ownership, intellectual property, warranties, and indemnification will continue to apply.

8. Third-Party Links and Services
HiLo may contain links to third-party websites, services, or offers. We do not control or endorse these third parties and are not responsible for their content, privacy practices, or terms. Your interactions with third parties are at your own risk.

9. Disclaimers and Limitation of Liability
HiLo is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, HiLo and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or reputation arising from your use of the Service.

10. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the United States and the State of Delaware. Any disputes arising out of or related to these Terms will be resolved in the courts of Delaware, unless otherwise required by law.
